1. Introduction
This DMCA Takedown Policy applies solely to the reporting of copyright-infringing content posted on JustFans. If you need help with the removal of infringing content on other websites, please contact us here: info@justfans.io
2. DMCA Notice & Content Removal Process
Although our website ("the platform") is not operated in the United States, we respect the intellectual property rights of copyright holders and have decided to voluntarily comply with the provisions of the Digital Millennium Copyright Act ("DMCA").
JustFans is considered a 'Service Provider' under 17 U.S.C. § 512(k)(1) of the DMCA and can therefore rely on certain liability protections ('Safe Harbor') for copyright infringements.
We respect the intellectual property of third parties – and expect the same from our users. Therefore, we adhere to the provisions of the DMCA and have implemented the following Notice and Takedown Policy for cases of alleged copyright infringements by users of our platform.
3. Notice of a Claimed Copyright Infringement (DMCA Notice)
If you believe that your work has been copied and posted on JustFans in a way that constitutes copyright infringement, please send a formal notice with the following information to our designated copyright agent (see below):
Please include the following in your notice:
(a) An electronic or physical signature of the person authorized to act on behalf of the copyright owner or rights holder.
(b) A description of the copyrighted work or intellectual property that you believe has been infringed.
(c) A precise description of the location of the allegedly infringing material on the website (ideally with specific URL links).
(d) Your mailing address, phone number, and email address.
(e) A statement from you that you believe in good faith that the use of the material is not authorized by the copyright owner, its agent, or the law.
(f) A sworn statement that the information in the notice is true and complete, and that you are the copyright owner or authorized to act on their behalf.

Without our prior express consent, our Designated Agent is not authorized to accept or waive service of process, and any further authority beyond receiving valid DMCA notices is expressly excluded.

Abuse Notice: Abusive use of the DMCA procedures described above or the intentional misrepresentation in a notice or counter-notice may lead to claims for damages, court costs, and attorney's fees under U.S. federal law. See: 17 U.S.C. § 512(f).
These notice-and-takedown procedures are exclusively for copyright owners and their authorized representatives who wish to claim an actual copyright infringement – not for other types of abuse, violations, or legal claims. We reserve the right to take legal action against anyone who abuses the DMCA process. Please ensure that you meet all legal requirements before sending a DMCA notice to our Designated Agent.
4. Content Removal Procedure (Takedown Procedure)
JustFans follows the following 'Notice-and-Takedown' procedure once a notice of an alleged copyright infringement is received.
The platform reserves the right to disable access to or remove content at any time that is alleged or clearly infringing upon copyrights – whether due to direct reporting or apparent circumstances.
It is JustFans' clear policy to terminate the account of repeat copyright infringers when necessary. JustFans will promptly take action to remove or block access to content that is proven to infringe third-party copyrights, following the procedure outlined in 17 U.S.C. § 512 DMCA.
The DMCA notice procedures of JustFans have been described in the previous section
If a notice does not fully meet the requirements under § 512 DMCA but contains at least three essential details for identifying the infringing website or content, JustFans will attempt to contact the reporting party or take other reasonable steps to complete the notice
Once the Designated Agent receives a valid notice, JustFans will promptly remove the infringing content or disable access to it and inform the affected user.
The affected user can then submit a counter-notice to the Designated Agent. This must include a sworn statement that the user believes in good faith that the material was removed due to a misidentification.
Upon receiving a valid counter-notice, JustFans will restore the removed content within 10 to 14 days, unless the reporting third party takes legal action in the meantime and informs JustFans in a timely manner (e.g., by providing proof of a filed lawsuit to prevent the alleged infringement).
5. DMCA Counter-Notice Procedure
If you, as the recipient of a DMCA notice regarding an alleged copyright infringement, believe that it is unjustified, erroneous, or incorrect and/or that content has been wrongfully removed, you can submit a counter-notice under § 512(g)(2) and (3) of the DMCA.
The counter-notice is the correct way to contest the removal or disabling of content.
The information provided in the counter-notice must be truthful and complete. You are responsible for any false statements, especially if they lead to legal claims against JustFans.
The following information is required in the counter-notice:
(a) A clear description of the content that was removed or disabled based on the original notice.
(b) A description of where the content was located on the platform, preferably with a specific URL or profile link, before it was removed or disabled.
(c) A statement that you believe the removal or disabling was made in error. You can use the following text: 'I declare under penalty of perjury that I believe in good faith that the material in question was mistakenly or erroneously identified as infringing material and therefore was removed or disabled by the service provider.'
(d) Your full address, phone number, and email address.
(e) A statement that you consent to the jurisdiction of the competent U.S. District Court in the district of your residence – or, if you reside outside the U.S., to any competent court district where the service provider (JustFans) is located – and that you are willing to accept legal service from the person who submitted the original DMCA notice, or their authorized representative
The written counter-notice with all the above-mentioned information must be signed and sent to the following address: dmca@justfans.io
Language and Legal Notice All DMCA notices and counter-notices must be written in English. Notices submitted in other languages or using non-Latin characters will be considered non-compliant and will not be processed.
Please do not send general inquiries or other information to our Designated Agent. Without our prior express consent, our Designated Agent is not authorized to accept legal documents or waive service of process. Any further authority to represent us is expressly excluded.
Procedure After Receiving a Valid Counter-Notice After receiving a DMCA-compliant counter-notice, our designated copyright agent will forward it to us. We will then send the counter-notice to the person who submitted the original notice in which the affected content was reported as infringing.
If we or our designated agent do not receive a legal notice from the original claimant within ten to fourteen (10-14) days of receiving the counter-notice, indicating that legal proceedings to prohibit the disputed use have been initiated, we will restore access to the affected content or lift the access restriction.
Changes to this Policy: JustFans reserves the right to modify, adjust, or supplement this policy at any time. All concerned individuals should visit this page regularly to stay informed about any updates.
